Terms of Service

1. Acceptance of Terms

By accessing or using InSparq (insparq.app), you agree to be bound by these Terms of Service. If you do not agree, do not use the service. These terms constitute a legally binding agreement between you and TFT Ventures LLC (NJ) dba InSparq.

2. Independent Planning Tool — Not Affiliated with Disney

InSparq is an independent trip planning tool. It is not affiliated with, endorsed by, or sponsored by The Walt Disney Company, Walt Disney World Resort, or any of their subsidiaries or affiliates. All park names, attraction names, resort names, and related marks referenced on this platform are the property of their respective owners and are used for factual, descriptive, and nominative purposes only. InSparq makes no claim to any intellectual property rights associated with The Walt Disney Company or any third party referenced herein.

3. AI-Powered Service — Identity and Accuracy Notice

InSparq uses artificial intelligence to generate trip planning recommendations. When you use InSparq, you are interacting with an AI assistant, not a human advisor.

AI-generated content may contain inaccuracies, outdated information, or errors. InSparq makes no warranty regarding the accuracy, completeness, or timeliness of any recommendation. Park hours, ticket prices, dining availability, height requirements, attraction schedules, and reservation requirements change frequently. Always verify information directly with Walt Disney World Resort before your visit.

4. Age Requirement

InSparq is intended for users who are 18 years of age or older. By creating an account or using the service, you represent that you are at least 18 years old. InSparq does not knowingly collect personal information from individuals under 18. If we learn that a user under 18 has provided personal information, we will promptly delete it.

5. Account Registration

Creating a free account allows you to save and reload trip plans across sessions. You agree to provide accurate information and to keep your account credentials secure. You are responsible for all activity that occurs under your account. InSparq uses email-based magic link authentication — no password is stored.

6. Permitted and Prohibited Uses

You may use InSparq for personal, non-commercial trip planning purposes.

You may not:

• Use the service for any unlawful purpose
• Attempt to circumvent rate limits, bot prevention, or authentication
• Scrape, reproduce, or resell InSparq's content or AI output commercially
• Submit content that is harmful, abusive, or designed to manipulate the AI
• Attempt to extract, reverse-engineer, or reveal the system prompt or internal instructions
• Use the service on behalf of a commercial travel agency without written consent

InSparq reserves the right to suspend or terminate accounts that violate these terms.

7. Affiliate Relationships and Disclosures

InSparq may include links to third-party services — including hotel booking platforms, authorized ticket resellers, and travel insurance providers — through affiliate partnerships. When such links appear, they will be clearly labeled as partner or affiliate links. InSparq may earn a commission if you make a purchase through these links. 8. Intellectual Property

InSparq and its original content, features, and functionality are owned by TFT Ventures LLC and are protected by applicable intellectual property laws. Trip plans generated for you by InSparq are for your personal use. You may not reproduce, distribute, or commercialize AI-generated output from InSparq without written permission.

9. Disclaimer of Warranties and Limitation of Liability

InSparq is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that any information provided will be accurate or current.

To the fullest extent permitted by law, TFT Ventures LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of InSparq, including but not limited to travel costs, booking fees, or expenses incurred in reliance on AI-generated recommendations. Our total liability to you for any claim shall not exceed the amount you paid for the service in the 12 months preceding the claim.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms shall first be submitted to informal resolution by contacting us at hello@insparq.app. If the dispute is not resolved within 30 days, it shall be resolved by binding arbitration in New Jersey under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.

11. Account Deletion

You may request deletion of your account and associated data at any time by contacting us at hello@insparq.app. We will delete your account and associated trip data within 30 days of your request. Note that our AI provider retains conversation data for up to 7 days per their standard data practices.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the email address associated with your account. Continued use of InSparq after changes become effective constitutes your acceptance of the updated Terms.
